1. How to Enter: The JAKKS UFC® Tickets & Toys Giveaway (“Giveaway”) begins at 12:01 a.m. Pacific Time (“PT”) on October 12, 2009 and ends at 12:00 p.m. (noon) PT on December 1, 2009 (“Giveaway Period”). To enter, simply visit Facebook.com, search for “UFC Action Figures JAKKS Pacific”, and sign up to become a fan on the UFC Action Figures - JAKKS Pacific page (the “Webpage”) during the Giveaway Period. If you were already listed as a fan on the Webpage at the start of the Giveaway Period, then you are already automatically entered into the Giveaway. There is a limit of one (1) entry per person. JAKKS Pacific, Inc. (“Sponsor”) will not verify receipt of entries. All entries submitted become the sole property of Sponsor and will not be acknowledged or returned.
2. Eligibility: To be eligible to enter the Giveaway, you must, at the time of entry a) be a lawful permanent resident of the 48 Continental United States or the District of Columbia, b) be at least 18 years old, and c) be physically located in the U.S. The Giveaway is void outside of the 48 Continental United States and the District of Columbia, and where restricted or prohibited by law. Once you list as a fan on the Webpage, you must remain listed as a fan on the Webpage throughout the remainder of the Giveaway Period to remain eligible. Employees, officers and directors of Sponsor and its affiliated companies and subsidiaries, and the advertising and promotion agencies of each (collectively, “Giveaway Entities”), and their immediate families (defined as spouse, mother, father, sisters, brothers, sons and daughters) and members of their households (whether related or not) are ineligible to participate in this Giveaway.
3. Privacy: All information submitted to Sponsor as part of this Giveaway will be treated in accordance with Sponsor’s privacy policy, available at http://www.jakks.com.
4. Drawing and Notification: The Sponsor, whose decisions are final and binding in all respects, will conduct a random drawing on or about December 1, 2009 to select one (1) Grand Prize winner from amongst all eligible entries received during the Giveaway Period i.e., all eligible persons listed on the Webpage as a “fan” as of the end of the Giveaway Period. Odds of winning a prize depend on the total number of eligible entries received during the Giveaway Period. The potential winner will be notified by email using the Facebook contact system. If the potential winner fails to respond to such winner notification email in the manner and within the time period specified in such email, or fails to provide all information requested, or fails to sign and return any affidavits, releases or other documents sent to such person by Sponsor by the deadline specified by Sponsor, then his/her entry will be disqualified and an alternate winner may be selected via a random drawing, if time permits.
5. Prize: One (1) Grand Prize. The Grand Prize consists of one (1) JAKKS UFC Tickets & Toys Giveaway Prize Pack, which includes two (2) tickets to UFC 107 in Memphis, Tennessee on December 12, 2009 (the “Event”); round-trip coach air transportation for two (2) people from the major U.S. airport gateway nearest the Grand Prize winner’s residence to Memphis, TN,; one (1) night hotel accommodations (double occupancy); one (1) full set of of JAKKS UFC Wave 0 Action Figures (a total of eight action figures); one (1) Official Scale Octagon Playset; and a replica UFC Championship Belt (Approximate Retail Value: $1232.00). The actual value of the prize may vary depending upon the location of the winner’s residence, fares at the time of travel and the value of services rendered and products provided at the time of the travel or prize fulfillment. Therefore, the value of the prize awarded may be lower or higher at the time it is fulfilled. Any difference between the actual value and the ARV will not be awarded. The Grand Prize winner and his/her travel companion must be able to travel together to Memphis on or before December 12, 2009 or on such other date as is specified by Sponsor. If winner cannot travel on the date specified by Sponsor, he/she may be disqualified and an alternate entrant may be selected as a potential winner, if time permits. The winner’s travel companion must be at least 18 years of age and his/her name cannot be changed on the airline tickets once ticketed. All elements of the Grand Prize trip are subject to availability and blackout periods. While the Sponsor will make every effort to provide admission to the Event, due to potential changes in the UFC schedule, illness or injury of the participants, inclement weather and/or other factors not within Sponsor’s control, admission to the Event is SUBJECT TO AVAILABILITY AND SPONSOR’S DISCRETION. If the Event is cancelled or postponed, then all other Grand Prize elements will still be offered. The Grand Prize winner must arrange travel with Sponsor. Grand Prize winner must comply with all hotel check-in requirements, including but not limited to the presentation of a major credit card. All meals, taxes, gratuities, incidentals (including mini-bar and entertainment expenses), car rental, taxicab fares, phone charges, public ground transportation, and any other expenses not specifically identified in these Official Rules as included in the prize are the responsibility of the Grand Prize winner. No transfers, substitutions, upgrades, credits for changes, refunds or cash equivalents for a prize are allowed except at Sponsor’s sole discretion. Sponsor reserves the right to substitute a prize of equal or greater value if a prize (or any prize element) cannot be awarded as described for any reason. There is a limit of one (1) prize per person. All prizes will be awarded. Please allow 4-6 weeks for delivery of the prize.
6. Prize Conditions: The potential winner will be required to execute an Affidavit of Eligibility, a Liability Release and a Publicity Release (where permitted by law) (collectively, “Affidavit/Release”). The travel companion of the Grand Prize winner must also sign and return a Liability Release and a Publicity Release prior to ticketing of the prize. Both the potential winner and his/her travel companion must be at least 18 years old. If a potential winner or any travel companion is deemed a minor in his/her state of residence, then the parent or legal guardian of such person must sign and return any documents referred to herein. If the potential winner fails to return such document(s) within the time indicated by Sponsor, or if the potential winner cannot be reached via the Facebook contact system within the time specified by Sponsor in the contact email, or if any potential winner is found to be ineligible, or if any prize notification to a potential winner is returned as unclaimed or undeliverable, or if any potential winner does not comply with the Official Rules, then the potential winner will be disqualified and an alternate winner will be selected. All taxes and fees associated with the acceptance of the prize are the sole responsibility of the prizewinner and he/she may be required to furnish appropriate tax documentation. The Grand Prize winner will be issued an IRS form 1099. Except where prohibited by law, the winner’s entry and acceptance of a prize constitutes permission for the Sponsor and those acting under its authority to use such winner’s name, photograph, likeness, statements, biographical information, voice, and city and state address on a worldwide basis, and in all forms of media, in perpetuity, for advertising and promotion purposes without review or further compensation.
7. Giveaway Conditions: The Giveaway is subject to all applicable federal, state and local laws of the United States only and is not subject to any laws outside of the United States. Except where prohibited, all issues and questions concerning the construction, validity, interpretation or enforceability of these Official Rules, or the rights and obligations of the entrant and Sponsor in connection with the Giveaway, shall be governed by, and construed in accordance with, the laws of the State of California, without giving effect to any choice of law or conflict of law rules (whether of the State of California or any other jurisdiction), which would cause the application of the laws of any jurisdiction other than the State of California. By participating, entrants agree to abide by and be bound by these Official Rules and the decisions of the Sponsor, whose decisions are final in all respects, and to waive any right to claim ambiguity in the Giveaway or these Official Rules. By participating, entrants also agree to release, discharge, indemnify and hold harmless the Giveaway Entities and each of their respective officers, directors, employees, representatives and agents from and against any claims, damages or liability due to any injuries, damages or losses to any person (including death) or property of any kind resulting in whole or in part, directly or indirectly, from acceptance, possession, misuse or use of any prize or participation in any Giveaway-related activity or participation in this Giveaway, or for any typographical or other error in the printing, offering or announcement of any prize. Each entrant further acknowledges that the Giveaway Entities have neither made, nor are in any manner responsible or liable for, any warranty, representation or guarantee, express or implied, in fact or in law, relative to any prize, including, but not limited to, its quality, mechanical condition or fitness for a particular purpose, except as may be expressly stated by Sponsor in or on the packaging of any products it manufactures.
8. Limitations of Liability: The Giveaway Entities are not responsible for a) lost, late, misdirected, undeliverable or incomplete online entries, email notifications or responses to the Parental Notification E-mail or other emails, or b) any malfunction, error, problem, failure, loss, omission, interruption, deletion, theft, destruction, unauthorized access to, alteration, unavailability, inaccuracy, degradation or delay in or of any telephone network or line, cable connection, satellite link or transmission, computer system or equipment, network, connection, system, hardware, software, programming, transmission, telecommunications, internet systems, servers providers, internet access providers, website, the collection, processing or retention of entry information, or any combination thereof, which may limit an entrant’s ability to participate or win a prize. The Giveaway Entities are also not responsible for any typographical errors, or other errors in the presentation, display or printing of any aspect of the Giveaway, including the awarding of prizes. Sponsor may prohibit an entrant from participating in the Giveaway or future giveaways or sweepstakes, or winning a prize, if, in its sole discretion, it determines that said entrant is attempting to undermine the legitimate operation of the Giveaway by cheating, hacking, deception, or other unfair playing practices (including the use of automated quick entry programs) or intending to annoy, abuse, threaten or harass any other entrants or visitors to Sponsor’s website(s). If for any reason this Giveaway is not capable of running as planned, including, but not limited to, a computer virus, bugs, tampering, unauthorized intervention, human error, fraud or any other causes beyond the reasonable control of Sponsor which corrupt or affect the administration, security, fairness, integrity or proper conduct of the Giveaway, then Sponsor reserves the right, at its sole discretion, to cancel, terminate, modify or suspend the Giveaway, in whole or in part, at any time, without notice, and select winners by randomly drawing from those eligible entries received up to the cancellation/suspension date as contemplated by these Official Rules. Caution: Any attempt by an entrant or any other person to deliberately damage Sponsor’s webpage or undermine the legitimate operation of the Giveaway may result in disqualification from this and any future giveaway or sweepstakes, and may be in violation of criminal and civil laws. Should such an attempt be made, Sponsor reserves the right to seek remedies and damages (including attorney’s fees) from any such entrant or person to the fullest extent of the law and to request criminal prosecution.

10. Winners List: To receive a winners list, send a #10 business sized, self-addressed, stamped envelope to: JAKKS UFC Tickets & Toys Giveaway Winners List, 22619 Pacific Coast Highway, Malibu, CA 90265. The return envelope must contain the requesting person’s full name and physical address. No post office box addresses or private mail box addresses are allowed. Winners lists requests will not be honored unless you comply with these requirements. Requests must be received by no later than thirty (30) days after the end of the Giveaway Period. Residents of Vermont may omit return postage.
